BENJAMIN, Judah (1811-1834). U.S. lawyer and statesman. Senator from Louisiana from 1853 until Louisiana seceded from the Union in 1861. He became the attorney general under Confederate president Jefferson Davis. During the War Benjamin served as secretary of war and secretary of state. After the Confederacy fell, he fled to England, where he was eventually named to the Queen's council. He retired in 1883 as one of the most venerated members of the British bar. Manuscript Document Signed “J.P. Benjamin” as Acting Secretary of War, 1p, 8.25” x 10.5” Richmond, October 4, 1861. Completed in manuscript. On “Confederate States of America / War Department” letterhead. Creases and spotting, flaws at right edge. Fine signature. Integral blank sheet backs up missing upper right corner. Very good condition. In full, “Sir, You are hereby informed that the President had appointed you First Lieutenant A.D.C. in the Provisional Army in the service of the Confederate States. You are requested to signify your acceptance or non=acceptance of said appointment: and should you accept you will sign before a magistrate the oath of office herewith, and forward the same with your letter of acceptance to this Department. Report duty to Genl Buckner.” On August 17, 1861, President Lincoln told his Secretary of War to “make out a commission for Simon B. Buckner, of Kentucky, as a brigadier-general of volunteers.” Buckner declined the appointment. On September 14, 1861, Buckner accepted the commission as a Brigadier General in the Confederate Army. After Confederate General Albert Sidney Johnston, commander of all Confederate forces in the West, moved his headquarters to Bowling Green, Kentucky, Buckner arrived to take command of central Kentucky. This October 4, 1861, document appoints 1st Lieutenant Charles F. Johnston as Aide-de-Camp to Brigadier General Simon B. Buckner.
