Law book, “Reports of Cases at Law, Agrued and Determined in The Supreme Court of North Carolina, from December Term, 1834, to June Term, 1836” by Thomas P. Devereux & William H. Battle, Raleigh, 1837, 634p. octavo, including several cases involving slaves, including “A deed conveying slaves to the trustees of a religious society, for the use of the society, vests no beneficial interest in teh trustees individually, and if it is intended to confer on the slaves the rights of freemen, while they are nominaly held in bodnage, it is inoperative, as being against public policy”; “Whether a deed of emancipation made before the passage of the acts of 1777 and 1799...is void merely becausee of the incapacity of the slave to take, or because of its illegality, or whether thereby the slave was forfeited...”; “If a slave, in defence of his life, and under circumstances stongly calculated to excite his passions of terror and resnetment, kills his overseer, the homicide is by such circumstances, mitigated to manslaughter...It seems, that the law would be the same, with respect to killing a master or temporary owner...Unconditional submission is the general duty of the slave. Unlimited power, is, in general the legal right of the master; but this does not authorize the master to kill his slave, and the slave has a right to defend his life, against the unlawful attempt of his master to take it...IF a slave resists his master, previous to any attempt on the part of the latter to take his life, and he afterwards kills his master he is guilty of murder...” This case involved an overseer who shot a negro slave and was then killed by said slave. More very interesting cases. FIne.
