Confederate imprint “Reports of Cases in Law, Argued and Determined in The Supreme Court of North Carolina, June Term, 1862.” By Hamilton C. Jones, Reporter, Salisbury, North Carolina, 1862, printed by J.J. Bruner, 532 p. octavo, leatherbound. Cases include several involving slaves - arsons, breach of contract, assaults, advancements of slaves and more. One case in particular is “State v. Nehemiah Norman” which involves a free man of color, named Richard Fisher, who was convicted for larceny, and sold into slavery for five years to cover his court costs. “Befor the expiration of this time, Fisher was taken up on the charge of killing one Hussell, who was founddead in his yard, and the defendant gave him five licks to make him show where the guns was, with which he killed Hussell. Peacock [his master] was present when Fisher was whipped, and gave his consent to it, and said it ought to be done...” The judge determined that Fisher was not guilty and that Peacock was guilty of assault as “we are clear the master cannot whip for an unlawful purpose. If the apprentice... be in the condition of one who can be whipped for correction, and we hold the man may be whipped for such an object...the power of punishment...would be restricted to lawful objects, and if, under pretense of correction, the master whipped of malice, or, which we regard as equivalent, for an illegal object, it would be a violation of law...In such cases, very blow is an unlawful battery....The five blows inflicted under the circumstances...[are] technically an indictable battery...” Also included are homicides, claims of lunacity, and more.
